Terms of Service

1. Overview

TurboApply AI is a Talent Signal Engine operated by Turbostone Technologies (OPC) Private Limited. We provide both free analytical tools (such as our ATS Resume Scorer) and paid Managed Executive Outreach, targeting publicly available roles and the hidden job market to help candidates reach decision-makers directly.

2. Eligibility & Data Accuracy

Users must be at least 18 years old. By using our platform, you represent and warrant that all professional data, resumes, portfolio links, and credentials provided to us are entirely truthful and accurate. You agree that TurboApply AI is not responsible for verifying your credentials and you assume all liability for any false information submitted to employers on your behalf.

3. Account Responsibility

You are responsible for your account security. We are not liable for any misuse due to user negligence.

4. Use of Platform

You agree not to violate laws, disrupt our outreach servers, or use our Managed Outreach tools for spam or fraudulent activity.

5. Refund Policy, Visibility Guarantee & Scope of Service

• Service Initiation & User Responsibility: Access to the TurboApply AI platform and the initiation of your service (or subscription billing cycle) begins immediately upon sign-up and the provisioning of your dashboard access. It is strictly the sole responsibility of the user to submit their resume, job preferences, and required onboarding documents. Failure, delay, or refusal by the user to provide these materials does not constitute “service not rendered” or “item not delivered” and will not be grounds for a dispute.
• Scope of Service & “Item Delivered” Definition: Our sole obligation and function is to pass your message on to hiring managers, distribute your profile, and execute job applications on your behalf once your materials are provided. We strictly do not guarantee job offers, interviews, or specific employment outcomes. By using our service, you acknowledge and agree that the active “delivery of service” is completely fulfilled the moment our system initiates your applications and outreach campaigns. Any payment disputes or chargebacks claiming “item not delivered” or “service not rendered”—whether due to a lack of interviews, employer responses, or the user’s own failure to upload required documents—will be deemed fraudulent and aggressively disputed using platform access logs and these terms as proof of service delivery.
• 30-Day Visibility Guarantee: If your Real-time Dashboard shows zero (0) recruiter profile views within the first 30 days of active outreach (which formally begins only after all required onboarding materials are submitted by the user), you are eligible for a refund of the purchase price. This refund will be issued minus any applicable, non-refundable third-party payment gateway processing fees (e.g., PayPal, Cashfree).
• Strict No-Refund Policy Outside the Guarantee: The Starter plan, as well as the one-time payments for the Pro and Platinum plans, are strictly non-refundable under any circumstances other than the specific 30-Day Visibility Guarantee mentioned above. We do not offer prorated refunds, partial refunds, or “buyer’s remorse” refunds for any scenario.

6. Subscriptions, Cancellations & PayPal

• Billing Structure: The Starter Monthly Plan operates on a recurring, auto-renewing monthly subscription. The Pro and Platinum plans are strictly one-time payments and will not incur recurring subscription charges.
• Cancellation Requirements: To avoid unintended recurring charges on the Starter Monthly Plan, the user assumes full responsibility for canceling their subscription prior to the start of their next billing cycle. Cancellations are only valid if executed via one of the following two methods:
  1. Submitting a direct, written cancellation request via email exclusively to support@turboapplyai.com.
  2. Manually canceling the active subscription directly from within the user’s personal PayPal dashboard.
• Zero Exceptions on Renewal Charges: Once a new billing cycle commences and a recurring payment is captured, that payment is final and non-refundable. We strictly will not issue refunds for forgotten cancellations, unused subscription time, or cancellation emails sent after the renewal charge has already been processed. Any chargebacks filed for authorized recurring payments will be immediately contested using these terms as binding evidence of authorization.

7. AI, Managed Content, and Free Tools

While our Expert Strategists and AI assist with outreach materials and resume scoring, you are responsible for final verification. Our ATS Resume Scorer provides AI-generated estimates based on industry standards and does not guarantee how specific third-party employer applicant tracking systems will process your resume. We act as a Talent Signal; we do not guarantee a final hire, specific interview calls, or job placements.

8. Recruiter & Employer Interaction

We facilitate High-Intent Outreach to employers on your behalf for both public and hidden roles. However, we do not guarantee specific employer responses or intervene in final hiring decisions.

9. Maverick B2B Employer Terms

Under our Maverick division, Turbostone Technologies (OPC) Private Limited provides B2B talent acquisition services to employers through two primary models:

A. Maverick Concierge (Outbound Contingency Terms)

• Placement Fee Structure: The placement fee for candidates introduced via Maverick Concierge is strictly twenty percent (20%) of the candidate’s first-year base annual salary (excluding bonuses and equity unless explicitly agreed). The fee is earned upon the candidate executing a binding offer letter and commencing employment (the “Start Date”).
• Invoicing & Payment Window: Invoices will be generated on or before the candidate’s official Start Date and must be settled in full within fifteen (15) calendar days of the Start Date (and in no event later than thirty (30) calendar days from invoice receipt). Late payments immediately void the replacement guarantee and incur a late payment interest fee of 1.5% per month (or the maximum allowed by law).
• One-Time Candidate Replacement Guarantee: If a placed candidate resigns or is terminated for cause within the first thirty (30) calendar days of employment, Maverick will provide a one-time, free replacement search for the same role. To qualify, the original invoice must have been paid within the required 15-day window, and written notice of departure must be provided to support@turboapplyai.com within seven (7) business days. This guarantee is void if the termination is due to company layoffs, restructuring, or job description changes. The placement fee remains non-refundable.
• Candidate Representation & Non-Circumvention: Any candidate introduced to the client by Maverick remains protected for a period of twelve (12) consecutive months from the date of introduction. If the client (or any affiliate) hires the introduced candidate for any position within this 12-month window, the standard 20% placement fee will immediately become due.

B. Maverick Inbound Pipeline (SaaS Platform Terms)

• Platform License & Scope of Use: Maverick Inbound provides algorithmic resume parsing, 7-signal candidate validation scoring, and ATS interception workflows. Platform access is governed by plan-specific processing volumes, billed as a recurring SaaS subscription or volume-based pricing.
• Candidate Data Processing & Compliance: The client retains full ownership of all applicant resumes and candidate records uploaded or routed into the system. Maverick processes applicant data solely to score, filter, and categorize candidates relative to active job requisitions.
• Algorithmic Scoring & Hiring Discretion: The scoring, matching indices, and candidate rankings generated by the software are advisory metrics designed to reduce manual screening overhead. The employer retains sole, non-delegable authority over all interviewing, selection, and hiring decisions. Due to the labor and compute resources required to process large volumes of resumes, payments for the Screening-as-a-Service model are strictly non-refundable.

10. Communications and Marketing

By creating an account or submitting your information through our free tools (e.g., the ATS Resume Scorer), you consent to receive transactional and promotional email communications from TurboApply AI. You may opt-out of promotional emails at any time by following the unsubscribe instructions included in those emails.

11. Indemnification

You agree to indemnify, defend, and hold harmless Turbostone Technologies (OPC) Private Limited, its officers, and employees from any claims, damages, or legal actions arising out of your use of the platform, your violation of these Terms, or any misrepresentation of your professional background and credentials to third-party employers.

12. Intellectual Property & Termination

All “Talent Signal” technology is owned by Turbostone Technologies (OPC) Pvt. Ltd. We reserve the right to terminate access for breaches of these terms.

13. Governing Law & Contact

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
